These terms & conditions apply to the update and support services provided by WPBakery team to you as a licensee of any GPL-licensed software provided by WPBakery for which you have paid the applicable fees.
Support services
WPBakery will provide a reasonable level of technical and end-user support regarding the software via e-mail and other channels as announced from time to time. Availability and manner of contacting will be published on the WPBakery website and other channels.
Update services
WPBakery will from time to time release updates to the software that improve functionality or address bugs or limitations. Further, at your request, WPBakery will strive to create updates that address issues identified by you, if reasonable and within the scope of the software. Such updates will be owned by WPBakery and made available under the GPL license as with all WPBakery software and updates thereto.
These updates are available to the customers who have purchased a license.
Consideration
Support and updates are only available for any software for which you have paid the applicable fees. For the first twelve months of this agreement, an initial fee is due. For subsequent months further fees are due as announced by WPBakery. Fees are due in advance and must be paid in the manner(s) as indicated by WPBakery. Refunds are available up to 15 days after payment. WPBakery may once every payment period adjust the fees for the next payment period.
Confidentiality
WPBakery shall keep strictly confidential all non-public information from you it may collect in connection with your use of the software. No obligation for confidentiality exists regarding any input for suggested updates.
Limitation of liability
Except in case of intentional misconduct or gross negligence, WPBakery accepts no liability for any damages caused in connection with the services under this agreement. This includes but is not limited to damages in the form of data loss, failure to operate, lost revenue or missed profits.
Automated Content
WPBakery, acting as a “provider,” may utilize artificial intelligence tools (“AI Tools”) to process your content (“Input”) and assist in generating websites, text, code, or other content (e.g., WPBakery AI). You, as a “deployer,” are responsible for any output generated by these AI Tools based on your Input (“Output”). You are also responsible for reviewing your Output to ensure it complies with applicable laws and these Terms of Service.
Any Outputs, including text, graphics, icons, code, fonts, names, and slogans, have not been reviewed for accuracy, bias, or intellectual property clearance. WPBakery makes no representation, warranty, or guarantee regarding the accuracy, reliability, or whether any Output may infringe upon third-party intellectual property rights. You should review the Output accordingly and seek independent professional legal advice before relying on any auto-generated Output.
Additionally, you are responsible for labeling any text-based Output in compliance with applicable laws of your country and region.
To comply with the fair usage policy, WPBakery may review your Output. You are required to address any issues reported by WPBakery to avoid termination or legal action. Furthermore, as a “deployer,” you are obliged to inform WPBakery of any incidents or risks related to the use of AI Tools or Outputs.
Warranty
We are not responsible for any compatibility conflicts that may occur. It is our policy to support our plugins as best we can and we will provide support for 3rd party conflicts at our discretion or as time allows.
Term
The agreement is entered into on the day your initial fee payment is received by WPBakery and remains in force for an initial twelve-month period. Upon receipt of further payments, the agreement is renewed for successive monthly periods. Both you and WPBakery can cancel anytime with effect at the end of the then-current term.
Acceptance
By purchasing any software from WPBakery you indicate that you have read and agree to the Terms & Conditions detailed on this page.
Law and venue
Any disputes in connection with this agreement are governed by Cyprus law and must be brought before the courts of Nicosia, Cyprus.
